1. General

By booking or participating in our Jet Ski / Jet car Tour or Rental Service, you (“the Client”) agree to the following Terms & Conditions established by the operator (“the Company”). Please read these terms carefully before making a reservation.

2. Eligibility & Requirements

• All participants must be at least 16 years old to operate a jet ski.

• Participants under 18 must have written consent from a parent or legal guardian.

• A valid ID or passport must be presented before the activity.

• Clients must be in good physical condition and free from serious medical conditions (heart issues, back problems, pregnancy, etc.).

• The Company reserves the right to deny participation to anyone deemed unfit or under the influence of alcohol or drugs.

3. Booking & Payment

• Bookings can be made online, via phone, or in person.

• Full payment is required to confirm your reservation.

• Accepted payment methods include credit/debit cards, online transfer, or cash (subject to availability).

• Prices are quoted in AED and include VAT unless otherwise stated.

4. Cancellation & Refund Policy

• Cancellations made less than 24 hours before the start time or no-shows are non-refundable.

• The Company reserves the right to cancel or reschedule due to weather, technical, or safety reasons. In such cases, clients may choose between rescheduling or a full refund.

• Please be informed that refund it will take 10 to 15 days and there is minimum admin charge of seven percent.

5. Safety Rules & Obligations

• A mandatory safety briefing will be conducted before the ride. Participants must follow all safety instructions provided by the instructor or guide.

• Life jackets are mandatory at all times.

• Maximum speed limits must be respected as per instructor’s guidance.

• Reckless driving, dangerous maneuvers, or racing with other riders is strictly prohibited.

• The operator has the right to terminate the session immediately without refund if any unsafe or disrespectful behavior is observed.

6. Equipment Use & Responsibility

• The jet ski and all provided equipment must be used responsibly and returned in the same condition.

• Any intentional damage, loss, or misuse of the equipment will be charged to the client.

• The Company performs regular maintenance on all jet skis but shall not be held liable for unforeseen mechanical failures during the ride.

7. Weather & Sea Conditions

• The Company constantly monitors weather and sea conditions.

• Tours may be delayed, shortened, or canceled for safety reasons (e.g., strong winds, rough sea, poor visibility).

• In case of cancellation due to unsafe conditions, a full refund or reschedule will be provided.

8. Liability & Insurance

• Clients participate in the activity at their own risk.

• The Company, its employees, and affiliates are not liable for injuries, losses, or damages resulting from accidents, negligence, or failure to follow instructions.

• The Company maintains third-party liability insurance; however, personal travel insurance covering water sports is strongly recommended.

9. Personal Belongings

• Clients are advised not to bring valuables such as jewelry, phones, or wallets on the jet ski.

• The Company is not responsible for loss, theft, or damage to personal belongings during the activity.

10. Alcohol, Drugs & Behavior

• Alcohol consumption or drug use before or during the activity is strictly prohibited.

• The Company reserves the right to refuse service to any person under the influence of alcohol or drugs without a refund.

• Any aggressive or disrespectful behavior towards staff or other participants will result in immediate termination of the activity.

11. Photography & Media

• The Company may take photos or videos during the ride for marketing purposes.

• If you do not wish to appear in photos or promotional materials, please inform the staff before starting the session.

12. Damage & Penalties

• Any damage caused by negligence or reckless operation will be assessed and charged to the client based on actual repair costs.

• Failure to comply with safety instructions or local maritime regulations may result in penalties or legal action.

13. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising from participation in the Jet Ski Tour or Rental Service shall be settled under the jurisdiction of UAE courts.

 

Flyboard Terms & Condition

1. General

By booking or participating in the Flyboard Experience, you (“the Client”) agree to comply with the following Terms & Conditions established by the operator (“the Company”). Please read these terms carefully before confirming your reservation.

2. Eligibility & Participation Requirements

• Participants must be at least 16 years old to operate a flyboard.

• Participants under 18 years old require parental or guardian consent.

• A valid ID or passport must be presented before the activity.

• Participants must be in good physical and mental health, capable of swimming, and free from any serious medical conditions (including back, neck, heart, or respiratory issues).

• Pregnant women are not allowed to participate for safety reasons.

• The Company reserves the right to refuse participation to anyone deemed unfit or under the influence of alcohol or drugs.

3. Booking & Payment

• Bookings can be made online, via phone, or in person at our location.

• Full payment must be made in advance to confirm the reservation.

• Accepted payment methods: credit/debit cards, bank transfer, or cash (subject to availability).

• All prices are quoted in AED and include VAT unless otherwise stated.

• The use of flyboard equipment involves inherent risks; clients participate at their own risk.

6. Equipment Use & Responsibility

• All flyboard equipment is regularly inspected and maintained to ensure safety.

• Participants are required to handle the equipment responsibly.

• Any damage caused by negligence, misuse, or reckless behavior will be charged to the client.

• The Company shall not be liable for minor mechanical failures or technical interruptions during the session.

7. Weather & Sea Conditions

• Flyboard sessions are subject to suitable weather and sea conditions.

• In case of strong winds, rough waves, or poor visibility, the session may be delayed, shortened, or rescheduled for safety reasons.

• The Company will not be held responsible for cancellations due to adverse weather, but participants will receive an option to reschedule or get a refund.

8. Liability & Insurance

• The Company prioritizes safety, but participation is entirely at the client’s own risk.

• The Company, its employees, and affiliates are not responsible for injuries, losses, or damages resulting from accidents, negligence, or failure to follow instructions.

• It is strongly recommended that clients have personal travel or health insurance covering water sports activities.

9. Personal Belongings

• Clients are advised not to bring valuable items such as jewelry, phones, or wallets during the activity.

• The Company is not responsible for any loss, damage, or theft of personal belongings.

10. Alcohol, Drugs & Conduct

• Participation under the influence of alcohol, drugs, or any intoxicating substances is strictly prohibited.

• The Company reserves the right to refuse service to anyone showing signs of intoxication or unsafe behavior.

• Aggressive, disrespectful, or unsafe conduct toward instructors or other participants will result in immediate cancellation of the session without refund.

11. Photos & Videos

• The Company may take photos or videos during your Flyboard session for promotional purposes.

• If you do not wish to appear in such media, please inform the instructor or staff before the session begins.

12. Health Declaration

By signing or booking, the participant confirms that they are physically fit and have disclosed all relevant medical conditions. Failure to do so releases the Company from any liability related to medical issues arising during the activity.

13. Damage & Penalties

• Any intentional or negligent damage to equipment will be charged to the participant based on repair or replacement cost.

• The participant will be held responsible for any fines resulting from violation of local maritime laws during the session.

14. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising from participation in the Flyboard Experience shall be resolved under the jurisdiction of UAE courts.

Scuba Diving Terms & Condition

1. General

By booking or participating in our Scuba Diving Experience, you (“the Client”) agree to comply with the following Terms & Conditions set by the operator (“the Company”). Please read these terms carefully before confirming your booking.

2. Eligibility & Health Requirements

• Participants must be at least 10 years old (depending on certification level and dive depth).

• Participants must be in good physical health and able to swim.

• Individuals with heart conditions, lung or respiratory diseases, ear problems, sinus issues, or who are pregnant must not participate in scuba diving.

• A medical questionnaire and liability waiver must be completed before diving.

• The Company reserves the right to deny participation to anyone deemed medically unfit or under the influence of alcohol or drugs.

3. Certification & Training

• Certified divers must present a valid diving certification card (e.g., PADI, SSI, NAUI).

• Beginners or uncertified participants must complete a Discover Scuba Diving briefing with an instructor before entering the water.

• All divers must follow the instructor’s directions and safety rules at all times.

4. Booking & Payment

• Bookings can be made online, by phone, or in person.

• Full payment is required in advance to confirm the reservation.

• Accepted payment methods include credit/debit cards, bank transfer, or cash (subject to availability).

• Certified divers bringing personal equipment are responsible for ensuring it is safe and in working condition.

7. Safety Rules

• All participants must attend the mandatory safety briefing before the dive.

• Divers must follow depth limits and stay with their dive buddy or instructor at all times.

• Rapid ascents, breath-holding, or failure to follow instructions can cause serious injury or death.

• Alcohol consumption or drug use before or during the dive is strictly prohibited.

• The instructor’s decisions regarding safety are final and must be respected.

8. Medical & Health Declaration

• By booking, participants declare that they are in good health and have disclosed all relevant medical conditions.

• Participants understand that scuba diving carries inherent risks, including decompression sickness, drowning, and equipment failure.

• The Company is not liable for any injuries or medical conditions arising during or after the dive.

9. Liability & Insurance

• The Company takes all reasonable safety measures, but participants dive at their own risk.

• The Company, its staff, and affiliates are not responsible for accidents, injuries, losses, or damages beyond their control.

• Personal travel or diving insurance covering water sports and emergency evacuation is strongly recommended.

10. Weather & Sea Conditions

• Diving activities depend on favorable weather and sea conditions.

• The Company may reschedule, shorten, or cancel a dive due to strong currents, poor visibility, or storms.

• If a dive is canceled for safety reasons, clients will be offered a reschedule or full refund.

11. Conduct & Behavior

• Participants must behave responsibly and respect other guests, staff, and the marine environment.

• Touching or disturbing marine life, collecting shells, or damaging coral reefs is strictly forbidden.

• The Company reserves the right to refuse participation or end the activity without refund in cases of inappropriate or unsafe behavior.

12. Photography & Media

• The Company may take photos or videos during the dive for promotional purposes.

• If you do not wish to appear in promotional materials, please inform our staff before the dive.

• Underwater cameras may be used, but divers must follow safety guidelines and not distract others.

13. Personal Belongings

• The Company is not responsible for loss, damage, or theft of personal items.

• Participants are advised to leave valuables (phones, jewelry, cash, etc.) in a safe place before the activity.

14. Damage & Penalties

• Any damage caused to the boat, diving equipment, or marine environment due to negligence will be charged to the responsible individual.

• Violation of UAE maritime or environmental laws may result in fines or legal action.

15. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes or claims related to the Scuba Diving Experience will fall under the exclusive jurisdiction of the UAE courts.

Parasailing Terms & Condition

1. General

By booking or participating in our Parasailing Experience, you (“the Client” or “Participant”) agree to comply with all Terms & Conditions set by the operator (“the Company”). These terms are designed to ensure safety, transparency, and an enjoyable experience for all guests.

2. Eligibility

• The minimum age for parasailing is 12 years.

• Participants under 18 years old must have a parent or legal guardian’s consent.

• The maximum weight per flight is determined by current weather and wind conditions, generally between 50 kg and 180 kg per person.

• Guests must be in good physical health and free from any medical conditions that could be aggravated by parasailing.

• Pregnant women and individuals with heart, neck, or back problems cannot participate.

3. Health & Safety Requirements

• All participants must wear a life jacket and safety harness provided by the Company.

• Instructions and a safety briefing will be given prior to the flight. It is the participant’s responsibility to listen carefully and follow all instructions.

• The Company reserves the right to refuse participation if a guest appears to be under the influence of alcohol, drugs, or medication that may impair judgment.

• Parasailing is a weather-dependent activity; safety is always the first priority.

4. Booking & Payment

• All bookings must be confirmed with full payment in advance.

• Accepted payment methods include credit/debit cards, cash, or online payment.

• Prices are in AED and include applicable taxes unless otherwise stated.

• Bookings are confirmed only after receiving payment and a confirmation email or voucher from the Company.

5. Cancellation & Refund Policy

• Cancellations made within 48 hours of the booking time or no-shows are non-refundable.

• If the Company cancels the activity due to unsafe weather conditions, technical issues, or operational reasons, clients will be offered a full refund or rescheduling option.

6. Safety Rules & Regulations

• All participants must attend the mandatory safety briefing before takeoff.

• Life jackets and harnesses must be properly secured at all times.

• Participants must remain seated during takeoff and landing unless instructed otherwise.

• No mobile phones, cameras, or loose items are allowed during flight unless securely attached.

• The pilot/instructor’s decision regarding safety and flight conditions is final and binding.

• Failure to follow crew instructions may result in termination of the activity without a refund.

7. Weather Conditions

• Parasailing is subject to wind speed, wave height, and visibility.

• The Company may cancel or delay flights for safety reasons without prior notice.

• In such cases, participants will be offered a reschedule or a full refund.

• Weather decisions are made at the sole discretion of the Company’s captain and crew.

8. Equipment & Maintenance

• All parasailing equipment (boat, parachute, harness, tow line, and safety gear) is regularly inspected and maintained according to industry standards.

• Participants are responsible for using the equipment correctly as instructed.

• Any intentional damage or loss caused by negligence will result in additional charges to the participant.

9. Liability & Assumption of Risk

• By participating, guests acknowledge that parasailing involves inherent risks, including but not limited to: falls, collisions, equipment failure, sea conditions, and weather changes.

• The Company, its staff, and affiliates are not liable for any injury, damage, loss, or death resulting from participation, unless caused by gross negligence.

• Participants are strongly advised to have personal travel or activity insurance covering water sports and emergency evacuation.

• The Company is not responsible for lost or damaged personal belongings during the activity.

10. Conduct & Behavior

• Participants must act responsibly and respect the staff, equipment, and other guests.

• Unsafe, disrespectful, or reckless behavior will result in immediate termination of the activity without refund.

• Alcohol consumption is strictly prohibited before or during the activity.

11. Media & Photography

• The Company may take photos or videos during the parasailing experience for promotional purposes.

• By participating, guests grant the Company permission to use these images in marketing materials.

• Participants who do not wish to appear in photos or videos must inform the staff before the activity begins.

12. Personal Belongings

• The Company is not responsible for any loss or damage to personal items such as phones, cameras, wallets, or jewelry.

• Participants are encouraged to store valuables in a safe place before departure.

13. Force Majeure

• The Company shall not be held responsible for any cancellation or modification of the activity due to unforeseen circumstances such as extreme weather, natural disasters, government restrictions, or equipment failure beyond its control.

14. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes or claims related to this parasailing activity shall fall under the exclusive jurisdiction of the courts of the UAE.

Kayak Terms & Condition

1. General

By booking or participating in the Kayaking Rental (“the Activity”) organized by the Company, you (“the Participant” or “the Client”) agree to the following Terms & Conditions. These rules are designed to ensure your safety, comfort, and enjoyment throughout the experience.

2. Eligibility

• The minimum age for kayaking is 10 years.

• Participants under 18 years old must have written consent from a parent or legal guardian.

• All participants must be in good physical health and able to swim.

• Pregnant women, individuals with heart conditions, back problems, or other medical issues that could be aggravated by physical activity should not participate.

• The Company reserves the right to refuse participation to anyone deemed unfit or under the influence of alcohol or drugs.

3. Health & Safety Requirements

• Life jackets are mandatory and must be worn at all times.

• Participants must follow all safety instructions provided by the instructor or guide.

• Kayaking involves physical exertion and exposure to natural conditions such as sun, wind, and water; participants should stay hydrated and use sun protection.

• The Company will provide a safety briefing prior to the activity.

• Any participant who fails to follow instructions may be removed from the activity without refund.

4. Booking & Payment

6. Equipment & Usage

• All kayaking equipment (kayak, paddle, life jacket, and safety gear) is provided by the Company and is regularly maintained.

• Participants are responsible for handling the equipment carefully and returning it in good condition.

• Any damage, loss, or misuse of equipment due to negligence will result in a replacement charge.

• Personal belongings taken on board are the participant’s responsibility.

7. Safety Rules

• Participants must remain seated in the kayak and maintain balance at all times.

• It is strictly prohibited to stand up, jump off, or capsize intentionally.

• Participants must stay within designated kayaking areas and follow the guide’s directions.

• Alcohol or drug use before or during the activity is strictly prohibited.

• In case of emergency, participants must immediately notify the instructor or lifeguard.

8. Weather Conditions

• Kayaking is a weather-dependent activity.

• The Company may delay, reschedule, or cancel sessions due to strong winds, waves, rain, or poor visibility.

• In such cases, the client will have the option to reschedule or receive a full refund.

• The Company’s decision regarding weather conditions and safety is final.

9. Personal Belongings

• Participants are advised not to bring valuables such as phones, jewelry, or wallets during the activity.

• The Company is not responsible for loss, damage, or theft of any personal belongings.

• Waterproof bags (if provided) reduce but do not guarantee complete protection from water.

10. Liability & Assumption of Risk

• Participants acknowledge that kayaking involves inherent risks, including capsizing, falling into the water, collision, or environmental hazards.

• By taking part, participants accept all risks associated with the activity.

• The Company, its staff, and affiliates shall not be liable for any injury, damage, or loss incurred during or after the activity unless caused by proven negligence.

• Participants are encouraged to have personal travel or activity insurance covering water sports and emergency rescue.

11. Conduct & Behavior

• Participants must act responsibly, respect others, and follow staff instructions at all times.

• Disrespectful, reckless, or dangerous behavior will lead to immediate termination of the activity without refund.

• The Company reserves the right to deny participation to anyone violating safety standards or public conduct policies.

12. Media & Photography

• The Company may take photos or videos during the kayaking session for promotional purposes.

• By participating, guests grant permission for such use unless they opt out before the activity.

• Participants are welcome to take personal photos but must ensure it does not interfere with safety or navigation.

13. Damages & Penalties

• Participants are financially responsible for any intentional or negligent damage to equipment, boats, or facilities.

• Violation of UAE marine safety regulations may lead to fines or legal action by local authorities.

14. Force Majeure

• The Company shall not be held responsible for delays, cancellations, or damages caused by events beyond its control, including weather changes, government restrictions, or natural disasters.

15. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of UAE courts.

Paddle Board Terms & Condition

1. General

By renting a Paddle Board from (“the Company”), you (“the Renter” or “the Participant”) agree to the following Terms & Conditions. These terms are designed to ensure your safety and to protect the Company’s equipment and operations. Please read carefully before signing or making a booking.

2. Eligibility

• The minimum age for renting a paddle board is 12 years old.

• Participants under 18 years old must be accompanied by a parent or legal guardian.

• All participants must be in good physical condition and able to swim.

• Pregnant women and individuals with serious medical conditions (such as heart problems, epilepsy, or back injuries) should not participate.

• The Company reserves the right to refuse service to anyone deemed unfit or under the influence of alcohol or drugs.

3. Safety & Equipment

• A life jacket must be worn at all times while on the paddle board.

• All renters must attend a short safety briefing before entering the water.

• Paddle boards, paddles, and safety equipment are provided by the Company and must be used as instructed.

• The Renter is responsible for ensuring that all equipment is in good condition before use.

• The Company’s staff may deny participation if weather or sea conditions are unsafe.

4. Rental Duration & Fees

• Rental time begins once the equipment is handed over to the renter.

• Late returns will incur an additional charge according to the Company’s hourly rate.

• Prices are quoted in AED and include applicable taxes unless stated otherwise.

• Full payment must be made in advance before using the equipment.

• Accepted payment methods: credit/debit cards, online payment, or cash.

• Paddle boards must only be used within designated areas and under safe weather conditions.

• It is strictly prohibited to:

  • Tow other objects or people.

  • Attempt tricks or jumps that risk damaging the board.

  • Paddle in restricted or boating zones.

• The Renter must return all equipment in the same condition as received.

• Any damage, loss, or theft of equipment will result in repair or replacement charges at current retail value.

7. Safety Rules

• Always wear your leash and life vest while on the board.

• Keep a safe distance from swimmers, boats, and other watercraft.

• Do not paddle under the influence of alcohol or drugs.

• If weather or waves worsen, return to shore immediately.

• The Company’s staff decisions regarding safety and weather are final.

8. Weather Conditions

• Paddle boarding is subject to wind, wave, and tide conditions.

• The Company reserves the right to cancel or reschedule rentals in case of unsafe weather.

• Refunds or rescheduling will be offered accordingly.

• No refund will be issued once the rental has started unless the session is stopped by the Company for safety reasons.

9. Personal Belongings

• The Company is not responsible for loss or damage to personal belongings.

• Waterproof bags or phone cases may be available, but their use is at the renter’s own risk.

• It is recommended to leave valuables in a safe or locker before the activity.

10. Liability & Assumption of Risk

• The Renter understands that paddle boarding involves inherent risks, including falling into the water, collisions, and changing sea conditions.

• By signing or booking, the Renter voluntarily assumes all risks associated with this activity.

• The Company, its staff, and affiliates are not liable for injuries, damages, or losses arising from participation, except in cases of proven negligence.

• The Renter is responsible for ensuring personal medical or travel insurance that covers water sports.

11. Conduct & Behavior

• Renters must behave respectfully toward staff, other participants, and marine life.

• Any rude, reckless, or dangerous behavior will lead to termination of the rental without refund.

• Alcohol consumption or intoxication during the rental period is strictly prohibited.

12. Media & Photography

• The Company may capture photos or videos during the rental for marketing purposes.

• By participating, you grant permission for the use of your images unless you inform the staff beforehand.

• Renters may take personal photos but must do so without compromising safety.

13. Damage, Loss, or Theft

• The Renter is financially responsible for any loss, theft, or damage to equipment caused by negligence or misuse.

• A damage report will be completed, and repair or replacement costs will be charged accordingly.

• In cases of theft or major damage, the Company reserves the right to take legal action under UAE law.

14. Force Majeure

• The Company is not responsible for cancellations or interruptions caused by events beyond its control, including extreme weather, natural disasters, or government restrictions.

15. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of UAE courts.

Kite Surfing Terms & Condition

1. General

By renting or using kite surfing equipment (“the Equipment”) from (“the Company”), you (“the Renter” or “the Participant”) agree to these Terms & Conditions. These terms are designed to ensure your safety, protect the Company’s equipment, and establish clear responsibilities between both parties. Please read them carefully before signing or making a booking.

2. Eligibility

• The minimum age for kite surfing rental is 16 years old.

• Participants under 18 years old must have written consent from a parent or legal guardian.

• All renters must be able to swim and have basic kite surfing experience.

• Beginners without certification are required to take a lesson or safety briefing before renting.

• Participants must be in good physical condition. Pregnant women and individuals with heart, neck, or back problems must not participate.

• The Company reserves the right to deny service to anyone deemed unfit or under the influence of alcohol or drugs.

3. Certification & Experience

• Certified riders must present a valid kite surfing license or certificate (e.g., IKO, VDWS).

• The Company may conduct a skill assessment before approving rental use.

• Inexperienced participants must hire a supervised or assisted session for safety reasons.

4. Equipment Provided

• The rental package includes:

  • Kite, board, harness, bar, pump, leash, and safety gear (helmet and buoyancy vest).

• All equipment is regularly maintained and inspected by the Company.

• The renter must check the equipment before use and report any damage immediately.

• Once accepted, the renter assumes full responsibility for the equipment until it is returned.

5. Rental Duration & Fees

• Rental time starts when the equipment is handed over and ends upon return.

• Late returns will incur additional charges per hour.

• All payments must be made in advance before the start of the rental.

• Prices are quoted in AED and include VAT unless otherwise stated.

• Accepted payment methods: credit/debit cards, online payment, or cash.

6. Safety Rules

• Wearing a helmet, impact vest, and leash is mandatory.

• The renter must always stay within the designated kite surfing zone.

• Launching, landing, or riding in swimming areas or near boats is strictly prohibited.

• The renter must maintain a safe distance from other riders and beach users.

• It is forbidden to use the equipment in strong winds, storms, or offshore wind conditions.

• Alcohol and drug use before or during kite surfing are strictly prohibited.

• The Company’s staff may terminate a session immediately if safety rules are violated.

7. Weather Conditions

• Kite surfing is a weather-dependent activity.

• The Company reserves the right to cancel, postpone, or shorten the rental due to unsafe wind, waves, or visibility conditions.

• If canceled by the Company for safety reasons, renters may reschedule or receive a full refund.

• Refunds are not available once the activity has started, except when stopped for safety reasons by the Company.

8. Cancellations & Refunds

• Cancellations made at least 24 hours in advance are eligible for a full refund.

• Cancellations made within 24 hours or no-shows are non-refundable.

• The Company may cancel rentals at any time due to safety concerns, weather conditions, or operational issues.

• Refunds (if applicable) will be processed within 7–10 business days.

9. Equipment Damage, Loss, or Theft

• The renter is fully responsible for any damage, loss, or theft of equipment during the rental period.

• Repair or replacement costs will be charged according to the current retail value of the item.

• If damage results from negligence or misuse, the renter will bear all associated costs.

• The Company reserves the right to hold a security deposit until all equipment is returned and inspected.

10. Liability & Assumption of Risk

• The renter understands that kite surfing involves inherent risks, including falls, collisions, equipment failure, and changing sea conditions.

• By renting, the participant voluntarily assumes all risks and agrees to release the Company, its employees, and affiliates from any liability for injuries, losses, or damages.

• The Company is not responsible for accidents caused by misuse of equipment, unsafe behavior, or weather changes.

• Participants are advised to have personal insurance covering water sports and emergency medical assistance.

11. Personal Belongings

• The Company is not responsible for loss or damage to personal items such as phones, cameras, or wallets.

• It is strongly advised to store valuables in a safe location before starting the activity.

12. Conduct & Behavior

• Participants must respect the staff, other guests, and the environment.

• Reckless or disrespectful behavior will result in termination of rental without refund.

• Deliberate damage to equipment, property, or the marine environment will result in fines and possible legal action under UAE law.

13. Photography & Media

• The Company may take photos or videos during the rental session for promotional purposes.

• By participating, renters grant permission for such use unless they request otherwise before the activity.

• Personal cameras or GoPros are allowed only if securely attached and used safely.

14. Force Majeure

• The Company is not responsible for cancellations, delays, or damages caused by events beyond its control, including extreme weather, technical failure, or government restrictions.

15. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising out of or relating to this agreement shall be settled under the exclusive jurisdiction of the UAE courts.

Yacht Terms & Condition

1. General

By booking or renting a yacht (“the Yacht”) from (“the Company”), you (“the Renter” or “Client”) agree to comply with these Terms & Conditions. These terms are designed to ensure the safety of all guests, protect the Yacht and equipment, and establish the responsibilities of both parties. Please read carefully before confirming your booking.

2. Eligibility & Guest Requirements

• All guests must be at least 18 years old to make a booking.

• Children under 18 must be accompanied by a parent or legal guardian.

• All guests must be in good physical health and able to participate safely in onboard activities.

• The Company reserves the right to refuse boarding to any person under the influence of alcohol, drugs, or unsafe behavior.

• Maximum guest capacity must not exceed the Yacht’s legal limits as per UAE maritime regulations.

3. Booking & Payment

• All bookings must be confirmed with full payment unless otherwise agreed.

• Accepted payment methods include credit/debit cards, bank transfer, or cash.

• Prices are in AED and include VAT unless otherwise stated.

• Bookings are only confirmed once a confirmation email or voucher is received.

• Any special requests (catering, decorations, excursions) must be confirmed in advance.

4. Cancellation & Refund Policy

• Cancellations made at least 72 hours before the rental date are eligible.

• Cancellations made within 72 hours or no-shows are non-refundable.

• In cases of cancellation by the Company due to adverse weather, technical issues, or safety concerns, clients may choose to reschedule or receive a full refund.

• Please be informed that refund it will take 10 to 15 days and there is minimum admin charge of seven percent.

5. Safety & Conduct

• Life jackets must be worn when required or when instructed by the crew.

• Guests must follow all safety instructions provided by the Captain or crew.

• Reckless behavior, such as jumping overboard without permission, unsafe use of equipment, or consuming alcohol irresponsibly, may result in immediate termination of the rental without refund.

• Smoking is allowed only in designated areas onboard.

• Guests are responsible for personal belongings during the rental.

6. Weather & Sea Conditions

• Yacht rental is subject to suitable weather and sea conditions.

• The Company reserves the right to delay, cancel, or shorten the rental for safety reasons.

• Refunds or rescheduling options will be offered in the event of cancellation due to unsafe weather conditions.

• Decisions by the Captain regarding safety, navigation, or weather conditions are final and binding.

7. Equipment & Maintenance

• The Yacht, including all onboard equipment, is regularly inspected and maintained by the Company.

• Guests must handle equipment responsibly. Any damage, loss, or misuse will be charged to the renter.

• The renter is responsible for the condition of onboard equipment during the rental period.

8. Liability & Assumption of Risk

• Guests acknowledge that yacht rental involves inherent risks, including but not limited to slips, falls, swimming incidents, collisions, or natural hazards.

• Participation is at the guest’s own risk, and the Company is not liable for any injury, loss, or damage except where caused by proven negligence.

• Guests are strongly advised to have personal travel or activity insurance covering maritime activities.

9. Personal Belongings

• The Company is not responsible for loss, theft, or damage to personal items brought onboard.

• Guests are advised to keep valuables secure and minimize items taken onboard.

10. Alcohol & Catering

• Alcohol consumption is permitted only for guests of legal drinking age in accordance with UAE laws.

• External alcohol may require prior approval from the Company.

• Catering and food services must comply with hygiene and safety standards set by the Company.

11. Damage, Loss & Penalties

• Guests are responsible for any damage or loss to the Yacht or onboard equipment caused by negligence, misuse, or unsafe behavior.

• Charges for repair or replacement will be calculated at market or retail value.

• The Company reserves the right to retain a security deposit until all equipment and the Yacht are inspected.

12. Photography & Media

• The Company may take photos or videos onboard for promotional purposes.

• By participating, guests grant permission for use of images unless they notify the Company otherwise before the rental.

• Guests may take personal photos, provided it does not interfere with safety or navigation.

13. Force Majeure

• The Company is not responsible for cancellations or interruptions due to events beyond its control, including extreme weather, natural disasters, or government restrictions.

14. Governing Law

These Terms & Conditions are governed by the laws of the United Arab Emirates.
